In the state of Wisconsin, a Former Republican Attorney General and Waukesha County Circuit Court Judge Brad Schimel has created a permanent injunction, formalizing “substantially the same terms” as one he issued in October 2022. Schimel has ruled that voters in the swing state are not permitted under law to cancel an absentee ballot they already cast via mail in order to request a new ballot.
Schimel, as reported by The Daily Caller, found in favor of Restoring Integrity and Trust in Elections after the group launched a lawsuit on behalf of Wisconsin voter Nancy Koranic, claiming that the Wisconsin Elections Commission told clerks in August of that year that the process known as “ballot spoiling” was lawful. The Democratic National Committee and ‘Rise’, a radical left activist group, fought the suit.
In his ruling Schimel states, “The court finds that the statutes governing the absentee voting process are generally unambiguous,” adding that the law “says very clearly that, with two enumerated exceptions, ‘the municipal clerk shall not return the ballot to the elector.’” Simply put, the exceptions are if the ballot is spoiled or damaged or if…
